This public policy will

  • permit eligible foreign nationals with valid temporary resident status as visitors to apply for a job offer-supported work permit from inside Canada
  • exempt eligible foreign nationals from the requirement that a work permit not be issued if they have not complied with certain temporary residence conditions
  • allow eligible former temporary foreign workers to work while a decision on their work permit application is pending

 Eligibility requirements for visitors to apply for an employer-specific work permit

The foreign national

  • is in Canada with valid temporary resident status as a visitor, including status extensions under subsection 183(5) of the Immigration and Refugee Protection Regulations (IRPR), that is, maintained status, at the time of work permit application submission
  • has submitted an employer-specific work permit application using the Application to Change Conditions, Extend my Stay or Remain in Canada as a Worker [IMM 5710]
  • has remained in Canada with status since application submission
  • submitted the application on or before February 28, 2023

Note: If the application is approved, the new status and period of authorized stay will apply. If the application is refused, when status is extended under subsection R183(5), the expiry date of the period of authorized stay becomes the decision date on the application submitted. Eligibility requirements for interim authorization to work in addition to meeting the eligibility criteria for the work permit, a former work permit holder who converted to visitor status may also be eligible for interim authorization to work if they meet all the following:

  • have valid temporary resident status at the time of work permit application submission and have remained in Canada with status since;
  • held a valid work permit in the 12 months preceding the date on which they submitted their application for a work permit under this public policy, even though they are now only a visitor;
  • intend to work for the employer and occupation specified by the LMIA or LMIA-exempt offer of employment included in their work permit application submitted under the public policy;
  • have applied to IRCC for the interim authorization to work as per this public policy using the IRCC Web form; and
  • have requested that the authorization to work be applicable until a decision is made on their work permit application.

Foreign work needs a work permit to work legitimately in Canada. At times, the employer needs to issue Labor Market Impact Assessment (LMIA), or a work market test, to employ a Foreign worker.

Canada has a generally low work rate an abundance of job opportunities. Therefore, there are a larger number of occupations open than there are laborers to fill them. The Canadian government through its immigration programs aims to welcome foreign workers to support and sustain the country’s labor market shortages.

There are two significant work permit programs: the Temporary Foreign Worker Program (TFWP), and the International Mobility Program (IMP).The significant distinction between the two is that the TFWP expects employer to get a LMIA, whereas IMP work permits are LMIA-exempt.

Temporary Foreign Worker Program (TFWP)-LMIA based work permit

A Labour Market Impact Assessment (LMIA) is a document that an employer in Canada may need to get before hiring a foreign worker.A positive LMIA will show that there is a need for a foreign worker to fill the job. It will also show that no Canadian worker or permanent resident is available to do the job.

International Mobility Program

The International Mobility Program allows Canadian employers to hire foreign workers on a Canada work permit without the need for a Labour Market Impact Assessment (LMIA).

Positions exempt from requiring a LMIA are those which:

· Provide broad economic, cultural or other competitive advantages for Canada, and

· Provide reciprocal benefits for Canadian citizens and permanent residents.

Workers who are eligible for the International Mobility Program (IMP) include:

Those entering Canada as part of trade treaties, such as the Canada-United States-Mexico Agreement (CUSMA) or the Comprehensive Economic Trade Agreement (CETA).

· Those entering Canada on an open work permit.

· Those entering Canada as intra-company transferees.

Eligible occupation for open work permit-:

You may be eligible for open work permit if you fall under following categories-:

· International students

International students who graduated from a designated learning institution and are eligible for the Post-Graduation Work Permit , which allows them to work for at least three years if they completed at least two years study program. Study permits longer than 8 months and shorter than 2 years may be eligible for PGWP that matches the length of their stay.

· Student who’s no longer able to meet the costs of your studies (destitute student)

· Have an employer-specific work permit and are being abused or at risk of being abused in relation to your job in Canada

· Applied for permanent residence in Canada

· Dependent family member of someone who applied for permanent residence

· Spouse or common-law partner of a skilled worker or international student

· Spouse or common-law partner of an applicant of the Atlantic Immigration Pilot Program

· Refugee, refugee claimant, protected person, or their family member

· Under an unenforceable removal order

· Temporary resident permit holder

· Young worker participating in special program

International Experience Canada (IEC) is designed to allow foreign youth from over 30 different works in Canada. It gives youth the opportunity to travel and work in Canada for up to 2 years.
