Some temporary residency permit holders are eligible for extension whereas certain programs like the Post-Grad

uation Work Permit (PGWP) holders cannot extend their permit because PGWP is a onetime deal, However, that does not necessarily mean these workers cannot be eligible for a different work permit. If they want to continue working inside Canada, they can apply for LMIA based

work permit.

Determining Eligibility

Visitors are a class of temporary resident who are legally authorized to enter Canada temporarily to visit family, vacations or for business purposes. They are restricted in length of stay and are subject to various other conditions.
If your current temporary resident status is still valid you can apply

Canada

for an extension of your stay. For any permit, applicant should apply at least 30 days prior to the expiry of current status. Your original temporary status as a visitor continues under the same conditions until your application is finalized and you have been notified of the decision.
If your temporary resident status has expired, do not apply for an extension as you are not eligible. However, if you wish to stay in Canada after your status has expired you may apply for restoration of status within 90 days of your offence (loss of status) or you must leave Canada.

How can I determine the expiry of my temporary resident status?

When you arrived in Canada and gave your passport to the official, they approved your visit by setting a stamp in your visa or issuing an additional document. If there is no stamp, a handwritten date or document in your passport, your temporary resident status will expire six months from the day you arrived in Canada. If you were given a visitor record, study or work permit, the expiry date is marked on the document.

Restoration of status

You may be able to restore your status as a visitor, student or worker within 90 days of losing it, if you lost it because:
• you stayed in Canada longer than the period authorized for your stay (but not longer than 90 days).
• you changed employers, location of employment, or type of work (occupation or level of responsibility) before getting a new work permit.
• you changed the type of studies, educational institutions, location of studies, or times and periods of studies without applying to change these conditions on your study permit if they were specified on your study permit.
You may still be eligible for restoration if you continue to meet the initial requirements for your stay and have not failed to comply with other conditions imposed.
If you wish to obtain a new study or work permit and restore your temporary resident status, you must
• submit your application within 90 days of losing your status
• provide full details of all the facts and circumstances that resulted in you committing the offence
• keep meeting the requirements for your stay
• meet all the conditions listed on your permit, and
• pay the restoration fee ($200)

Conjugal Partner Sponsorship

This category applies for those who do not qualify under the spousal sponsorship class or common-law partner. A conjugal relationship is a connection between two individuals who are in a marriage-like connection but are not married and can’t live together because of conditions outside their ability to control. Difference between Conjugal Partner and spouse

A conjugal partner is different from a spousal partner in the sense that for a person to qualify as a conjugal partner, marriage isn’t a defining factor. The definition of a conjugal relationship isn’t restricted to just a physical relationship but a mutually interdependent relationship. For a relationship to qualify as a conjugal one, the two individuals must be interdependent on each other i.e financially, socially, emotionally or on physical grounds.
Spouses are married couples who are legally married to each other in the country of their residence or where the marriage took place. If the marriage took place outside of Canada, the marriage is considered legal by the IRCC only if it is considered legal in the country where the marriage has occurred. Spouses can be both opposite-sex and same-sex couples.

Who can sponsor a conjugal partner?

You can sponsor your conjugal partner if you are-:
• at least 18 years old
• a Canadian citizen, a person registered in Canada as an Indian under the Canadian Indian Act or a permanent resident,
• living in Canada:
o if you’re a Canadian citizen living outside Canada, you must show that you plan to live in Canada when your sponsored relative becomes a permanent resident.
o You can’t sponsor someone if you’re a permanent resident living outside of Canada.
• able to prove that you are not receiving social assistance for reasons other than a disability, and;
You must also be able to show that you can provide basic needs for:
• yourself,
• your spouse or partner,
• your spouse or partner’s dependent child(ren) (if applicable)

How much money do you need to sponsor your spouse, conjugal partner, or common-law partner to Canada?

Unlike most other forms of Canadian sponsorship, you do not need to demonstrate a minimum amount of income to sponsor a spouse, conjugal partner, or common-law partner. However, whenever you sponsor a family member to Canada, you must sign an undertaking, in which you promise to provide financial support for the basic needs of your sponsored family member. The length of the undertaking depends on the category of sponsorship.

How can I apply ?

Application can either be submitted via mail or by IRCC’s new permanent residence application portal.

WHAT DOCUMENTS WILL I NEED FOR A CONJUGAL PARTNER SPONSORSHIP?

You’ll have to give documentation that exhibits the validity of your relationship. This can be as call logs, gifts and receipts, confirmation of trips together, evidence of time spent together, and so forth anything you can give that shows that you are a substantial and real relationship will fortify your case. As well as demonstrating the validity of your relationship, intimate accomplices will likewise have to show the difficulties they face to live together. Exhibiting this isn’t really a simple undertaking as you’ll need to demonstrate genuine difficulty and this kind of class is commonly reserved for those who would otherwise be together, but because of outside forces beyond their control, they cannot.

  • Proof that you are leaving your spouse or kids in the nation of origin, for example, copies of marriage and birth declarations.
  • Documentation of a current business or work that you will get back to, for example, a business license or a letter from your employer and copies of paystubs
  • Copies of bank articulations showing that you keep up with accounts in your home country. Keeping an open ledger at home can demonstrate a monetary bind to your home country, particularly in the event that you are young and unemployed or do not have a background marked by business.
  • Property evaluation from CA, lease agreement for business you are operating
  • A sworn affidavit from the family members stating they are emotionally dependent on you and you are likely to return once your temporary visa expires.
  • Documentation of your professional potential in your home country, including insights from a respectable source, for example government, showing that your occupation is popular and in high demand in your home country; or a letter from a potential employer.
  • Documentary proof of any investments in stock or bonds or property.
  • GIC account receipt (in case of student visa)

Common Reasons for student visa rejections-:

Every year 30% of the total student visa applications are rejected. Most of these rejections are based on some of the common reasons.

  • Lack of proof of funds
  • Wrong choice of program
  • Lack of language competency
  • Improper explanation in the SOP for the course and college selection
  • Intention to not come back to my home country after completion of studies.

Express Entry Provincial Nominee Programs

In 2015, Canada presented Express Entry as a framework to oversee applications for Permanent residence. Therefore, numerous Canadian provinces and territories have created ‘upgraded’ PNP streams that are lined up with Express Entry. This implies that some PNPs expect that a candidate has an Express Entry profile to meet the PNP qualification prerequisites. Assuming that a candidate is assigned through a PNP which is aligned with Express Entry, the candidate can claim 600 Comprehensive Ranking System (CRS) points, practically ensuring they will surely get an to (ITA) for PR in  the following Express Entry draw.

Procedure

Express Entry PNP Option 1-:

  • Candidates must meet minimum Federal skilled worker, Federal Skilled trade or Canadian express entry stream requirements.
  • Applicants apply directly to PNP through their Express entry stream, if you receive the nomination.
  • You can create an Express Entry profile (or update your profile if you already have one) and include the PNP nomination.
  • Once you receive the ITA, you have to submit your PR application online within 60 days.

Express Entry PNP option 2-:

  • Create an Express Entry profile and show the provinces and territories you are interested in.
  • When selected, PNP sends a Notification of Interest to the candidate.
  • You will apply directly to PNP through EE stream
  • You will receive a PNP nomination.
  • Once you receive the ITA, you have to submit your PR application online within 60 days.

What is Express Entry?

Express entry was launched by the Canadian government in Jan 2015 for skilled and qualified applicants to make Canada their permanent home. The new Express Entry program was then launched to oversee applications for long-lasting homes for foreigners who can fill occupations where there is an absence of accessible talented Canadian laborers.adult sex toys

How does Express entry work?

Express entry is an online system. There are 3 immigration programs managed through Express Entry:

Federal Skilled Worker Program Federal Skilled Trades Program Canadian Experience Class
  • for skilled workers with foreign work experience
  • must meet criteria for education and other factors
  • for skilled workers who are qualified in a skilled trade
  • must have a valid job offer or a certificate of qualification
  • for skilled workers who have Canadian work experience
  • work experience must have been gained in the 3 years before you apply

Step 1-: Filling Online Express entry Portal

Applicants can fill out the online express entry form. Applicants are assessed on the basis of their Age, marital status, work history, educational qualification, language proficiency, however, they will be asked to answer questions based on these factors.

Applicants who effectively meet the measures of at least one of the federal economic immigration programs under Express Entry will then, at that point, be arranged into a pool of qualified people. These applicants will be positioned by their possibilities of financial and economic achievement and the highest-ranking candidates, along with those who have qualifying offers of employment or provincial/territorial nominations, will receive an invitation to apply for permanent residency.

Step 2: IRCC will issue you ITA

Highest ranked candidate will receive an ITA and substantially will be asked to submit the application. You will have two options once you receive an ITA either to decline the invitation or accept the invitation.

Accept the Invitation- If you accept the invitation you will have to submit all your documents like Birth certificate, Marriage certificates, Educational Documents, ECA, Language test scorecard, Past work experience letters, Police clearance certificates (all the countries you have stayed in for more than 6 months), Job offer if you have from any Canadian employer, Proof of relationship if you have close relative in Canada who is PR or Canadian Citizen. Make sure documents which you are providing at this stage are similar to the information provided by you in your profile before you received your ITA. Any incorrect, misleading information or document would lead to misrepresentation and you will be banned from applying under Canada’s immigration program for next 5 years.

Decline the Invitation:- You can choose to decline the invitation if you no longer want to move to Canada.

Step 3: After you apply

You will be contacted through the online portal as well as email address you used while submitting your profile for any further updates for instance request to get your biometrics, if required to ask for more documents, set up a meeting if necessary and to update you on what is the next step. Primarily decision on the application is based on your eligibility criteria for the program and your admissibility based on the results of medical exam, police certificates and background checks

IRCC will verify your information If you are not truthful in your Express Entry profile or application for permanent residence, they may refuse your application, find you inadmissible or bar you from applying to come to Canada for any reason for 5 years. If your application is rejected, to be considered in future rounds of invitation you will have to submit new express entry profile, meet the eligibility criteria and be accepted in the pool again.

If your application is approved you will receive COPR or a permanent resident visa (if you’re from a country that requires a visa) through mail. Your COPR will have information about who you are, as well as your photograph, it is imperative to check and make sure your information is correct. Your COPR should have the same information as the information on your passport. If there is a mistake on your COPR, contact IRCC through your account.

Please note: You cannot extend your COPR, so make sure to use it before it expires.

What is the CRS score?

The CRS is a points-based system that assess and score your profile and rank it in the Express Entry pool.

Express entry oversees three programs

  • Federal Skilled Worker (FSW)
  • Federal Skilled Trade (FST)
  • Canadian Experience Class (CEC)

Any individual who submits a profile to the Express Entry pool is assigned CRS score out of 1200 . Roughly after every two weeks, the Canadian government leads an Express Entry draw, where they issue a series of Invitations to Apply (ITAs) for Permanent residence to the highest- ranking candidates. CRS points are assigned on the basis of four factors-:

-Core / human capital factors
-Spouse or common-law partner factors
-Skill Transferability factors
-Additional points

How can I increase my CRS score?

1.  Improve your Language Test score.

Improving language score is the easiest and convenient method for increasing the CRS score. Good Language test score can all alone help you get up to 160 points. In any case, good language score and post-auxiliary schooling can get you an additional 50 extra points.
Applicant need to score Canadian Language Benchmark (CLB) 7 to be qualified for Express Entry under the Federal Skilled Worker program. Which is equivalent to 7 on each language ability on the CELPIP and 6 on each language ability on the IELTS. Ostensibly, scoring CLB 9 in all language abilities could definitely help in increasing the overall CRS score.

2.   Look for employer in Canada

Having a job offer from employer can help you score extra 50 points. You can look for a potential employers on websites like Job bank , Indeed and can also apply directly on the company’s websites.

3.      Provincial Nomination

Receiving provincial nomination can help in getting 600 additional points. Many provincial nomination program are lined up with Express Entry, however it’s normally dependent upon the applicant to sort out which programs they may be qualified for and how to apply. Remember that applying for a provincial nomination is normally a totally different application process.

4.      Educational Qualification

Another  efficient way to increase the score is by upgrading the educational qualification. Considering going back to school and acquiring higher education like master’s degree or doctorate degree can help in increasing the CRS score. Apparently, acquiring new abilities or finishing instructive program not just offers you the chance to build your CRS score yet in addition, it is a significant and important part of the skill transferability factor of the Comprehensive Ranking System.

5.      Work experience

Although you just need one year of work experience to qualify to apply for PR under Express entry. However, accumulating more  work experience can help in increasing the CRS score. Express Entry utilizes the National Occupational Classification (NOC) framework to assign points to all occupations. Picking the right NOC code is probably the least complex method for increasing your score. You’ll need to prove that whatever NOC codes you claim in your work experience are accurate if you receive an invitation to apply for permanent residence, so you should not misrepresent your experience, as misrepresentation can ban you to apply under any program for 5 years .

Note: You can check your CRS score on canada.ca Click Here

CRS score only gives you the tentative idea of your score, eventually once you submit your application under Express entry IRCC awards you the point within 24 hours which could sometimes be different from the score calculated on the website. So, you can use this tool as a benchmark rather than completely relying on it.
