Difference between Conjugal Partner and spouse

A conjugal partner is different from a spousal partner in the sense that for a person to qualify as a conjugal partner, marriage isn’t a defining factor. The definition of a conjugal relationship isn’t restricted to just a physical relationship but a mutually interdependent relationship. For a relationship to qualify as a conjugal one, the two individuals must be interdependent on each other i.e financially, socially, emotionally or on physical grounds.
Spouses are married couples who are legally married to each other in the country of their residence or where the marriage took place. If the marriage took place outside of Canada, the marriage is considered legal by the IRCC only if it is considered legal in the country where the marriage has occurred. Spouses can be both opposite-sex and same-sex couples.

Who can sponsor a conjugal partner?

You can sponsor your conjugal partner if you are-:
• at least 18 years old
• a Canadian citizen, a person registered in Canada as an Indian under the Canadian Indian Act or a permanent resident,
• living in Canada:
o if you’re a Canadian citizen living outside Canada, you must show that you plan to live in Canada when your sponsored relative becomes a permanent resident.
o You can’t sponsor someone if you’re a permanent resident living outside of Canada.
• able to prove that you are not receiving social assistance for reasons other than a disability, and;
You must also be able to show that you can provide basic needs for:
• yourself,
• your spouse or partner,
• your spouse or partner’s dependent child(ren) (if applicable)

How much money do you need to sponsor your spouse, conjugal partner, or common-law partner to Canada?

Unlike most other forms of Canadian sponsorship, you do not need to demonstrate a minimum amount of income to sponsor a spouse, conjugal partner, or common-law partner. However, whenever you sponsor a family member to Canada, you must sign an undertaking, in which you promise to provide financial support for the basic needs of your sponsored family member. The length of the undertaking depends on the category of sponsorship.

How can I apply ?

Application can either be submitted via mail or by IRCC’s new permanent residence application portal.

WHAT DOCUMENTS WILL I NEED FOR A CONJUGAL PARTNER SPONSORSHIP?

You’ll have to give documentation that exhibits the validity of your relationship. This can be as call logs, gifts and receipts, confirmation of trips together, evidence of time spent together, and so forth anything you can give that shows that you are a substantial and real relationship will fortify your case. As well as demonstrating the validity of your relationship, intimate accomplices will likewise have to show the difficulties they face to live together. Exhibiting this isn’t really a simple undertaking as you’ll need to demonstrate genuine difficulty and this kind of class is commonly reserved for those who would otherwise be together, but because of outside forces beyond their control, they cannot.
